EU Settlement Scheme

Freedom of Movement ended on 31 December 2020. EU, EEA (Iceland, Norway and Liechtenstein) and Swiss citizens living in the UK before this date need to apply to the EU Settlement Scheme to retain the right to live and work here.

The deadline for applying is 30th June 2021. Only those who have been granted indefinite leave to remain or have Irish Citizenship are exempt.

Applicants will either be given Pre-Settled or Settled status depending on how long they’ve been living in the UK.

Pre-settled status - applies to those who do not have 5 years continuous residence at the point when you apply. You can stay and work in the UK for a further 5 years from the date you get pre-settled status. You can then apply to change this to settled status once you’ve got 5 years continuous residence. You must do this before your pre-settled status expires.

Settled status - you’ve lived in the UK for a continuous 5-year period. You can stay and work in the UK as long as you like if you get settled status.

Candidates with settled or pre-settled status will be able to use a ‘share code’ to share and prove their status to employers.

The status of all EU citizens living in the UK will remain the same until after 30th June 2021 and candidates can continue to use their passport or national identity card to prove their right to work in the UK.

Recruiters or employers cannot require candidates to show their status under the EU Settlement Scheme until after this date.
